This might be stretching the design a bit, but right now the tabs serve a dual purpose (pages & dynamic states)... What if the tree navigated pages (selected branch = open page) and the tabs could be for the different layers within a page?  This would also alleviate the crowding that I frequently experience with the tabs, which are next ...
